Nokia gets it: launches patent lawsuits against HTC, RIM and ViewSonic

Image

Nokia has just announced that it is commencing patent litigation against HTC, Research in Motion and ViewSonic in the US and Germany. It's claiming that 45 of its standard-essential patents are being infringed and has registered complaints with the ITC and courts in Delaware, Dusseldorf, Munich and Mannheim. Espoo's legal chief Louise Pentland has said that the company currently licenses its FRAND patents to "more than 40 companies," it had no choice but to lay some courtroom smack-down on the named offenders. It appears that after losing its global market share crown and billion-dollar losses, the company is finally going on the offensive with its deep patent portfolio. You can judge that for yourself when you read the official line after the break.

Trayvon Martin case: Task force wants changes in Stand Your Ground

The group of legislators, attorneys, police and legal experts stopped short of calling for an absolute repeal.

An independent task force wants major changes, but not an outright repeal, of Florida's "stand your ground" law after the shooting death of teenager Trayvon Martin.

State Sen. Chris Smith, the organizer of the group, delivered the recommendations to Gov. Rick Scott and legislative leaders on Monday.

Smith said the group ? which included prosecutors, defense attorneys, police chiefs and law professors ? could not reach a consensus on whether to get rid of the seven-year-old law that allows a person to meet force with force if they reasonably believe they are in danger of being killed or seriously harmed. The law removed a duty to retreat that previously was in the state's self-defense law.

"We took an adult look at 'stand your ground," Smith said. "We had adult discussions, not political, but adult discussions on 'stand your ground.'"

Neighborhood watch volunteer George?Zimmerman?said he acted in self-defense when he killed Martin earlier this year in Sanford. A special prosecutor, however, charged?Zimmerman?with second-degree murder following weeks of outcry and protests.?Zimmerman?has posted bail and is currently in hiding as he awaits trial on the charges.

Smith, a critic of the existing law, put together his own task force to look at the law after complaining that Scott was waiting too long to respond to the Martin killing. A separate task force assembled by the governor is scheduled to hold its first meeting in Tallahassee on Tuesday.

Smith, D-Fort Lauderdale, said he would a sponsor in the bill in the Florida Legislature that includes the changes recommended by his group, including one that requires that a grand jury and not a prosecutor determine whether "stand your ground" can be used to avoid arrest.

Smith's group also called for creating a system to track self-defense claims in Florida and to make it clear that the police can detain and question someone even if the person contends they were acting in self-defense. Smith said the law is now ambiguous on whether police are allowed to detain a suspect.

The 21-page report by Smith's group includes recommendations that either had unanimous support, or a supermajority. Smith noted that only a simple majority supported a repeal of the stand your ground law and that he would not "waste" the time of the GOP-controlled Legislature or public by sponsoring a bill to repeal the law.

One recommendation that received a supermajority ? but not unanimous agreement ? was that police should be allowed to charge someone if the person killed was unarmed or was in the process of running away. Martin was unarmed when?Zimmerman?shot him.

Rep. Dennis Baxley, R-Ocala and a sponsor of the 2005 'stand your ground' law, said he's not surprised that Smith's group came up with recommendations to overhaul the law.

Baxley said he wanted the governor's task force to stay on its mission to look at all of the state's self-defense laws.

"The mission is not to have a kangaroo court and say's what wrong with stand your ground," said Baxley, who is a member of the governor's task force. "The importance of the mission is to review public safety and protection."

Other task force members said they could not comment until they had a chance to read Smith's report.

But Rep. Jason Brodeur, R-Sanford, said that he would be interested in anything to make "Florida a safer place" as long as it did not diminish the ability of Floridians to defend themselves or their families.

Smith on Monday repeated his push to have the Florida Legislature deal with the state's self-defense laws in a special session instead of waiting until next year's legislative session. He said the law continues to be "used and misused" throughout courtrooms and remains fearful of "copycat" crimes similar to what happened to Travyon Martin.

Smith also wanted to present his group's recommendations to the Scott-created task force at its first meeting. But Lt. Gov. Jennifer Carroll, who is leading the Task Force on Citizen Safety and Protection, turned down his request.

Her letter to Smith says it would be unfair to let him speak since no one else from the public is scheduled to address the group. She instead offered him to make a presentation in June.

"I guess I'll attend and maybe it put it on their windshield wipers on their cars campaign style afterwards," Smith said.

Most Newsletter Templates are Nonprofit Templates | MailChimp ...

MailChimp has many pre-designed templates for newsletters. We?re always adding more, too. A handful of these templates are designed specifically for nonprofit organizations, but most aren?t.

Here?s the thing, though: Nonprofits?can totally use the templates that aren?t specifically designated for nonprofits.

This isn?t exactly news. But maybe your micromanager needed to hear it from someone else. At the very least, the next time some know-it-all suggests that you ?run your nonprofit more like a business,? you can say that you use the same newsletter templates that businesses use. (Maybe this happens just before you issue a swift kick to said know-it-all?s shin.)

I?ve highlighted some templates that nonprofit organizations might like to use or edit to fit their brand guidelines. Let?s take a look at them, knowing that?yes?there are more, and?yes?you can always design your own from scratch.

Mobile

More and more of your subscribers are reading email on mobile devices. Mobile templates help get your message across without readers having to zoom in, zoom out, or ignore a bloated email on principle.

Holidays

While these examples aren?t exactly timely, I suspect Fabio is working day and night to create an?International Tuba Day?template. Meanwhile, there are a lot more holiday templates where these came from.

Surveys

You might not find our SurveyMonkey templates with the rest of the designer templates right away. That?s because they appear only after you activate?our SurveyMonkey integration. Just like the other templates, you can edit these to match your organization?s brand or personality.

Once you send out your survey, go to the Advanced Reports section to find your SurveyMonkey stats.

eCommerce

If your organization has some sort of retail arm, you might appreciate our eCommerce-specific templates. They don?t even care about your 501(c)(3) designation.

Events

Event templates deliver your invitation without having to worry about any additional newsletter content or design.

Stationery

Sometimes it?s best to send out word on something a little more formal. Say, if you?ve been awarded a major grant, or if your executive director is feeling important, or if the celebrity on your board has recently been arrested.

Nonprofit

Right now we?re boasting a handful of templates specifically for nonprofits. If you really like these (like I do), or if you?re a newsletter-template-title purist, these are for you.

Shelly's Health and Fitness Corner: Supplementing With More Than ...

This week I want to take the time and touch bases on using supplements and do we really need them. Most Americans diets lack vital nutrients that they need on a daily bases to help maintain homeostasis. People who are on diets, not sleeping or always rushed and on the go need extra micronutrients. For example, when we look at dieting, calories are being restricted. This means the individual is not getting enough vitamins and minerals through a balanced diet. Whole grains, fruits, veggies, legumes are being restricted or replaced by less nutritious foods such as 100-calorie cookies, chips or other snack food items. These foods lack in vitamins and minerals that your body needs. And for those who do eat a fair amount of fruits and veggies, they still may not be getting the amounts their bodies need. In fact, some fresh fruits and veggies that we buy in the stores lack in nutrition. Why? Because when they are shipped or have traveled over many miles they begin to loose nutritional value by a processes known as oxidation. In addition, these foods are grown in polluted soil or soil that has been over used by mass production. Also our plant sources of food are being nourished by an environment where the air is polluted. In turn, this poses a threat to our health. For instance, when plants are grown in parts where the air quality is poor, the plant absorbs these toxins, which now become a part of the food we eat. The outcome is more Americans are suffering from nutritional deficiencies and illnesses. It's best to buy local and organic produce when possible to get the most nutrition.

There is no doubt in my mind that stress dominates our daily lives resulting in a greater need for B vitamins, zinc, iron and copper. These micronutrients play a role in our bodies assisting with metabolizing energy and more. The demands on our bodies become so great and yet we don?t give it the nourishment it needs to work at peak performance. Our bodies have a way of letting us know when trouble is present. This can vary from inflammation, lack of sleep, illness etc?In my opinion, everyone should be supplementing. The question is, with what? A multiple vitamin should be apart of everyone?s nutritional program and it essential that it?s food based. Food based is a form that the body can recognize and utilize best. Most supplements found in some mass-market stores such as Costco or Sam?s may contain synthetic ingredients that the body cannot fully utilize and can cause nausea. Vitamins should be taken with food particularly fat-soluble vitamins E, D, A and K. I highly recommend Rainbow Light, not because I work for a broker who represents their product but because I?ve used their products myself and feel the difference. Rainbow Light has been around for many years and I remember when I use to work for Clark?s Nutritional Centers I was impressed by the quality and their need to meet the consumer?s demands based on their health needs. They also have a strong conviction of doing what?s right for the planet and giving back to those in need. Rainbow Light has program called Vitamin Angel's and they donate 1 bottle of prenatal vitamins to third world countries for every 10 bottles sold. Rainbow Light has specific multivitamins, minerals, dietary supplements and more. To learn more about their supplement line you can visit their website at www.rainbowlight.com . You can also purchase their products through your local health food store. I recommend Clark?s Nutritional Centers because the staff is trained and very knowledgeable. Feel free to email me with any questions you may have.

How would you change the LG Nitro HD?

Image

AT&T's LG Nitro HD is one of those rare devices your writer has actually used. We carried it as our daily driver during this year's CES and were won over by that gorgeous screen, speedy LTE and its thin and light design. Unfortunately our experience matched those in the review: herky-jerky performance and battery life that meant we were always on the lookout for a power point. Of course, you can't have amazing battery life without doubling its thickness, but would you have taken that compromise? We're asking you: how would you change it?
